Terms of Use

These Terms of Use (“Agreement”) govern your access to and use of the TransferVista software platform (“Software”), owned and operated by Marketup Media. By using the Software, you agree to be bound by this Agreement. If you do not agree, you must not access or use the Software.

1. Right to Modify Terms

Marketup Media reserves the right to modify, amend, or update these Terms of Use at any time, without prior notice. Continued use of the Software after such changes constitutes acceptance of the new terms.

2. Ownership and Intellectual Property

  • All source code, design, data structures, and content of the TransferVista Software, including but not limited to branding, logo, and interface, are the exclusive property of Marketup Media.
  • Copying, modifying, distributing, or reverse engineering any part of the Software is strictly prohibited.
  • The TransferVista name, logo, and all associated intellectual property are protected by applicable copyright and trademark laws.

3. License and Usage

  • A non-exclusive, non-transferable license is granted to the customer (licensee) for internal business use only.
  • The license is tied to the customer’s unique ID and may not be sublicensed, resold, leased, or otherwise provided to third parties or other companies.
  • Use of the Software outside the licensed company constitutes a material breach of this agreement. In such cases, Marketup Media reserves the right to immediately terminate access to the Software.

4. Pricing and Payment

  • Use of the Software is subject to a licensing fee, which may be billed monthly, semi-annually, or annually, or as a percentage of bookings, or as a combination of the above.
  • The agreed fee includes access to technical support.
  • Failure to make timely payments will result in automatic deactivation of the Software. All functionality will be suspended until payment status is restored to “active.”

5. Support and Updates

  • Technical support is included with all paid plans and provided during normal business hours.
  • Marketup Media may provide updates, improvements, or patches to the Software at its discretion, which may modify or change functionality.

6. Limitations of Liability

  • TransferVista is provided “as is” and “as available” without warranties of any kind, express or implied.
  • Marketup Media shall not be liable for:
    • Temporary or permanent interruption of service,
    • Software bugs, third-party service failures, or internet outages,
    • Any loss of revenue, data, or profits resulting from use or inability to use the Software.
  • The user explicitly waives any right to claim lost profits or damages from Marketup Media under any legal theory.

7. Acceptable Use and Restrictions

  • Users may only use TransferVista for its intended purpose: managing and operating transfer services, including setting areas and pricing for transfers.
  • Unauthorized or malicious use is strictly prohibited.
  • Any attempt to bypass licensing, hack, or misuse the system will result in immediate account suspension and legal action if necessary.

8. Termination

  • Marketup Media may terminate access to the Software immediately and without notice if these Terms are violated.
  • Upon termination, the user must immediately cease all use and destroy any locally stored content or backups of the Software.

9. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Greece. Any disputes shall be subject to the exclusive jurisdiction of the courts of Heraklion, Crete.
